That's not entirely true, many of the rights in the bill of rights are not actually limited to American citizens, For example the second Amendment is not restricted to citizens, legal aliens are part of "the people" and thus also have a right to bear arms for example. Same for speech. That said DACA was never legal in the first place so its insane that a judge would try to retain it.

Yep it was a MEMO. It wasn't an executive order, it didn't go through congress, etc. Technically there are no JUDGES of any kind that have any SAY on this topic as there was no LAW, no EXECUTIVE ORDER.

It's not legal.

The memo was essentially the administrator stating they were not going to enforce the laws they swore to enforce when swearing oath of office.

It was an action that the president could not have made even with an executive order. The congress would need to make a law, the president can't just decide to let them stay.

Yep. I know. I was simply pointing out that we didn't even have that. Just a memo from one of his administrators saying they were not going to do their job. :)
