Should the US and El Salvador send detained migrants and imprisoned citizens to the mega-prison in El Salvador?
For context, this is a question I answered on Quora
You cannot incarcerate U.S. citizens in a foreign country no matter how heinous their crime is because at the end of the day they still have 5th amendment rights to due process of law and a 6th amendment rights to legal counsel and cross examination of witnesses neither of which vanish after they are convicted and those rights aren’t enforceable outside U.S. jurisdiction. The 5th amendment recognizes post-trial due process rights that Salvadorian prison officials probably don’t. Sometimes new evidence emerges requiring retrial and convicts are allowed to appeal their convictions and sentences. U.S. citizens also retain the right to freedom of religion after conviction something I highly doubt Salvadorian prison officials care about.
