SLC22-W5/ GENDER VIOLENCE
Hi friends,
I am Jyoti from India. Here I am going to participate in the SLC S22 W3 contest: https://steemit.com/law-s22w3/@anasuleidy/slc22-w3-derechos-humanos-ddhh organised by @anasuleidy
Part I
Please tell us if there is a special law in your country to protect women's rights and what is your opinion regarding this law.
There ar many special lawas in our cointry india to protect women in variour ways such as Dowry Prohibition Act - 1961, Harassment of Women Prevention Act 1998, Protection of Girls from Sexual Offences Act - 2012.
Although a special law called "Protection of Women from Domestic Violence Act - 2005".
This Act declares that violence against women in families is not only physical, but also mental, emotional/verbal, sexual and economic violence.
• The Act also provides protection to the wife, female partner or female victim in the family from violence committed by the husband and his relatives and the male partner or his relatives living together without marriage.
• The Act protects the right of women to continue to live in the house they live in by preventing the eviction of a woman from her home.
• The Act provides a means for the victim to evict the adversary from the house or to get alternative accommodation or to have the adversary pay the rent for it.
• Victims of violence can file a case under this Act against any male perpetrator in their family. The husband, his relatives and the male partner can also be included as opponents in the case and a solution can be found.
Key features of the Act
• Ensures the right of a woman to share her husband's house.
• Ensures financial relief by recognizing economic violence.
• Recognizes emotional/verbal abuse and mental abuse.
• Provides temporary custody of the child to the mother.
• Judgments within 60 days of filing the case.
• Multiple judgments in the same case
• Cases under this Act can be filed even if other cases are pending between the parties.
Available remedies
» Section 18 Protection order
» Section 19 Order to reside in the matrimonial home
» Section 20 Money orders including maintenance for herself and her children.
» Section 21 Temporary custody of children
» Section 22 Compensation for damages caused to the woman by the man

Please state whether you consider this law to be effective and whether it does not violate the principle of equality before the law enjoyed by both men and women.
This Protection of Women from Domestic Violence Act - 2005 law is very safe for women. Through this, many women have regained their rights and are living well. Moreover, many crimes have decreased since the implementation of this law. Moreover, people are afraid of committing crimes against women in the family. However, it cannot be denied that most innocent men are affected when this law is abused. For example, under this law, any innocent man can be used to take a woman as a victim. Because in this, the first right is given to the statement of women. Men are less interrogated and men do not get a chance to explain themselves.
Part II
From the list of crimes mentioned in class, say which ones you consider may be crimes of gender violence and which ones may be common crimes committed against a woman or women.
The following are examples of gender-based violence directed towards women as said in class.
Psychological violence
Harassment or bullying
Threats
Physical violence.
Domestic violence
Sexual violence
Violent carnal access
Forced prostitution
Sexual slavery
sexual harassment
Workplace violence
Property and economic violence
Obstetric violence
Forced sterilization
Media violence
Institutional violence
Symbolic violence
Trafficking of women, girls and adolescents.
Trafficking of girls and adolescent women
I consider cases like Psychological violence, Harassment or bullying, Property and economic violence, Domestic violence, Symbolic violence and Threats are to be general cases and applicable to both genders. I do not consider Property and economic violence in particular to be a gender case for women.
Have you or someone close to you been a victim of gender violence. What was the situation? Was the victim able to assert her rights? Do you think the law favored the victim?
In our marriage customs, giving dowry is a practice. But it is illegal, but people buy it because it is customary. The people who marry the girl forcefully give dowry and send the girl to their house. But taking it by force is illegal.
The daughter of one of our close relatives was married off five years ago. When our relative's daughter got married, they promised to give her 50 sovereigns of gold jewelry, a car, and 10 lakhs in cash. But unfortunately, the girl's brother had an accident and had to undergo a surgery on his leg, which cost about 25 to 30 lakhs. Again, his income was also affected.
Due to this, they could not give the entire amount agreed upon from the girl's house to the groom's family, so the groom's family harassed the girl to get the money. There was a fight between them for about a year. In the end, the girl attempted suicide, and after the matter came to light, a case was filed against the groom's family.
A case was registered against them under four sections, one of which was the Protection of Women from Domestic Violence Act - 2005. Accordingly, the woman's husband was sentenced to six months in prison. The woman's mother-in-law and father-in-law were also sentenced to six months in prison and a compensation of Rs. 10 lakh was also awarded. But the accused were not given any prison sentence in the name of forgiveness by the woman's family.
Now both of them are divorced and living separately. The woman is not yet in the mood to get married again and is still afraid because her previous marriage was affected.
Part III
# Case Study 1.
Please state whether we are dealing with a femicide or a homicide committed against a woman. Explain your answer.
What he did is a crime that should be punished. But at the same time, it is not considered a crime against the female gender. This is a general crime and it is a crime against both genders. The crime he committed should be registered as a case of murder, public nuisance, carrying a weapon, theft, robbery etc. and action should be taken.
Case Study 2.
Please state whether this is a crime of gender violence or a common crime committed against a woman. Explain your answer.
This is considered a crime against women because in this, women's rights are denied and women are misused. Similarly, harassing and beating a woman is a crime against women. A case should be registered for this crime under the Harassment of Women Prevention Act, 1998, and Protection of Women from Domestic Violence Act - 2005 acts and the person should be given appropriate punishment. If the affected woman wishes, she should get a divorce from her husband and make way for her to live.

Excelente participación amiga, las mujeres deben ser protegidas por las leyes, aunque ellas mismas en algunos casos no hacen las denuncias respectivas y eso detiene la justicia.
Te deseo mucho éxito en este concurso. Saludos.

Yes, you are right. The only way for the affected women to get justice is if they file a complaint. Thank you very much for your wishes.
Your competition is very wonderful in which very good things have been said about women because if they face any kind of problem then they can take help from the government. Here women live with complete freedom. There the Decision can take it upon itself, and it's actually pretty good too.
