Public Law This law governs the relationship between individuals and the state. Government of the state is the main body to operate it. Everyone comes under this law, even the government itself too.
Two Types of Public law in Pakistan
Constitutional Law 1973 constitution is the supreme documented law of Pakistan. This constitution defines too many things, one of the prominent which i want to discuss here is Fundamental Rights Freedom of rights in Pakistan constitution explain the fundamental rights, including freedom of speech, equality before the law, and the right to education.
Criminal Law It comes under public law too. Pakistan penal code (PPC) known as the prominent and the primary criminal code in Pakistan, covering offenses like theft, murder, and fraud.
These both parts deal with public dealing, their is a direct implementing from government on general masses. State implement it’s power to make the people obey it.
Private Law This law deals with the relationships between individuals, organizations, and private entities. It regulates the disputes and transactions in private capacities, ensuring justice and fair dealings. It includes; civil law, family law, property law, and commercial law, etc.
Two Types of private law in Pakistan
Company and Commercial Law In Pakistan business related private is governed by ** Companies Act, 2017**. It regulates the formation, governance and other operations of the company.
Property Law The Land Revenue Act, 1967 and the Transfer of Property Act, 1882 are the laws which governs property dealing between two people.
There are many types of laws we know, but if talk specifically about the laws in the lesson i would say in public law category my favourite Criminal law and Labor Law. Criminal is for the reason, because it’s a code of conduct that safeguard us. The government on those who harms us or try to harm us.
Example, a murderer, a thief or a robber, why they can’t do these bad activities openly? It’s just because of this law we have. They are afraid of the penalties and the punishment the has announced for them.
Second in this category is labour law. I feel very empathetic to those poor labours i am seeing going to university. This law protects their rights and explain the obligations of both employers and workers.
In private law category i like family law. We Muslim have a too good Islamic family law, which reinforce all the rights of individual within a family and our current family law in our country is derived from that law. That’s why I claim that Pakistan’s family law is my favourite one.
The family law is very common and almost everyone of us knows about it. Here in Pakistan family matters are governs by Islamic personal law which we can say is a type of private law. Things like marriage, divorce, maintenance, etc comes under this law.
Recently one of my friends have her wedding. In wedding ceremony we have a specific contract called Nikkah. In nikkah both husband and wife have their signature. It’s a kind of agreement that yes we are agree to be each other’s spouse. Now this contract comes under Islamic personal law which is a branch of family law. It’s a recent example we attended her wedding few days ago.
I am a university student and we have Academic and Student Laws which regulates students regarding issues, such as discipline and conducts. Many reports has been seen in our university, where a student has been kick out of the university under the Academic and Student Law. We personally know some students, who for their miss conduct are struck off from the university.
This was all about my participation. I would like to invite my friends @drhira, @yahnel, @goodybest to share their participation.
