संविधान सभा ने भारतीय जनगण के मन को
पूरी तरह समझ और केंद्र में रख कर ही राष्ट्रीय सहमति
से भारतीय संविधान बनाया। हम भारत के लोग ये चार
शब्द उसी लोकनिष्ठा के प्रतीक हैं । संविधान बना तब
उसमें कर्तव्यों का उल्लेख तक नहीं था। 1976 में 44वें
संविधान संशोधन विधेयक के माध्यम से संविधान के
चौथे भाग में चतुर्थ (अ) जोड़ कर कर्तव्यों के निर्वहन की व्यवस्था की से दो करों में गई । इस व्यवस्था स स्पष्ट
है कि सभी मूल कर्तव्य राष्ट्रीय एकताअखण्डता
एवं प्रभुता को अक्षुण्ण बनाए रखने की प्रेरणा देते है ।

अधिकार शामिल है । हमारे संविधान में इन मूल
अधिकारों को इस आशा के साथ सम्मिलित किया
गया कि एक दिन सच्ची स्वतंत्रता का वृक्ष भारत में
विकसित होगा स्वतंत्र राष्ट्र का प्रत्येक नागरिक
अधिकारों की प्राप्ति का स्वप्न संजोता है। अधिकार व
सभ्य समाज के अस्तित्व का प्रतीक है। अधिकारों से
व्यक्ति का न केवल शारीरिक एवं मानसिक विकास
होता है अपितु इससे व्यक्ति को समाज में एक विशिष्ट
स्थान प्राप्त होता है। मूल अधिकार भारतीय संविधान
का मैग्नाकार्ट है। राज्य भी ऐसी कोई विधि नहीं बना
सकता तो मूल अधिकारोंसे असंगत हो या छीनने वाली हैं
हो या कम करने वाली हो। अधिकार कतिपय निर्बधों
से युक्त होते हैं।
