Illegal racing is a social problem that is considered difficult to eradicate. This phenomenon ebbs and flows along with the tight and loose law enforcement situation.

Budiyanto, an observer of transportation issues, said that the consistency and firmness of the apparatus in supervising and imposing sanctions affected the prevalence and absence of illegal racing.

From the perspective of the existing laws, said Budiyanto, illegal racing actors can be subject to multiple layers of articles in accordance with Law 22 of 2009 concerning Road Traffic and Transportation.

The former Head of Sub-Directorate for Gakkum Ditlantas Polda Metro Jaya said several articles that could be imposed were Article 274 paragraph (1), Article 287 paragraph (5), and Article 311.

Article 274 paragraph 1

Any person who commits an act that causes damage and/or disruption to the function of the Road as referred to in Article 28 paragraph (1) shall be sentenced to a maximum imprisonment of 1 (one) year or a maximum fine of Rp. 24,000,000.00 (twenty four million rupiah).

Article 287 paragraph 5

Everyone who drives a Motorized Vehicle on the Road violating the rules for the highest or lowest speed limit as referred to in Article 106 paragraph (4) letter g or Article 115 letter a shall be punished with imprisonment for a maximum of 2 (two) months or a fine of a maximum of Rp500. .000,00 (five hundred thousand rupiah)

Article 311

  1. Everyone who intentionally drives a Motorized Vehicle in a manner or condition that endangers life or property shall be punished with imprisonment for a maximum of 1 (one) year or a fine of a maximum of Rp. 3,000,000.00 (three million rupiah).

  2. In the event that the act as referred to in paragraph (1) results in a Traffic Accident with damage to the Vehicle and/or goods as referred to in Article 229 paragraph (2), the perpetrator shall be sentenced to a maximum imprisonment of 2 (two) years or a maximum fine of Rp. ,000,000.00 (four million rupiah).

  3. In the event that the act as referred to in paragraph (1) results in a Traffic Accident with minor injuries and damage to the Vehicle and/or goods as referred to in Article 229 paragraph (3), the perpetrator shall be sentenced to a maximum imprisonment of 4
    (four) years or a maximum fine of Rp. 8,000,000.00 (eight million rupiah).

  4. In the event that the act as referred to in paragraph (1) results in a Traffic Accident with the victim being seriously injured as referred to in Article 229 paragraph (4), the perpetrator shall be sentenced to a maximum imprisonment of 10 (ten) years or a maximum fine of Rp. 20,000,000. 00 (twenty million rupiah).

  5. In the event that the act as referred to in paragraph (4) results in the death of another person, the perpetrator shall be sentenced to a maximum imprisonment of 12 (twelve) years or a maximum fine of Rp. 24,000,000.00 (twenty four million rupiah).
