CPS: Is it lawful or legal?
Today we are exploring the topic CPS: is it lawful or legal? Let's jump in.
Lawfulness
We are going to visit USCODE, all codes signed into law are denoted with an asteric. (See example below)
So we see that title 35 - 40 are actually signed into positive law. Title42, however is not. Just a side note Social Security as a whole is not signed into positive law.
Positive law means:
Law enacted by a governmental authority
Enacted:
the process of turning a bill into law
Do you see how this is troubling? Let's specifically look for CPS code. Hammer it down.
NOT EVEN CAPTA is signed into positive law
CAPTA is the newer primary source for CPS authority. It's held under chapter 6 (and like many other programs insist its a public law "110 - 351"). The truth is that under scrutiny there is no lawful ground on which it can stand as again, it is not signed into positive law.
Is CPS legal?
While writing laws legislator generally produces bills that either rights strip, then ammend that to further a bill; or make rights friendly bills (not so often).
The truth of the matter is yes it's legal to an extent that it does not hurt or creates injury and that it does not infringe upon rights held by citizens. It's legal kidnapping.
I've demonstrated time after time that CPS lacks jurisdiction to take children. It is also fraud. It is also deprivation of rights. Hopefully, a light is going off.. as the three case files specify who has a right to children? Parents!
The heart of the matter is: everytime CPS exercises authority (even in deserving scenarios) someone is deprived of a right.

Todays lesson was small yet potent. I think the hang up is that many do not have enough confidence to read and start a process. The truth is it takes time, but research will always pay off.
It is the belief of certain judges that if family court issues continue to appear in Upper Courts; it will not bode well for the "statutes." Eventually they will be struck, I believe.
The hope of this article is to demonstrate the lawfulness of CPS. Which I believe I did demonstrate. As we progess, we will be simplifying the provisions. Thats all I am doing, simplifying everything in short easy to digest articles so the reader can understand perfectly the subject matter.

While I agree that cps can take children away from loving parents .... and may sometimes get the facts twisted ..... seeing the way some children in low income and poverty levels are raised ... there are too many times where cps should have acted and didn’t.... the mother in the south Bronx that leaves her toddler home alone with rodents running around and sleeping on a bare mattress ... while she is out at the club or bar . I have seen this happen way too often ... when someone should have interjected and taken These poor children away from their unfit families .
I agree with what you said here.
I think there needs to be a fundamentally fair procedure, or something.
Maybe they should revamp some of their methods but they definitely something in place to protect the children that are in unhealthy homes .
How does this go unnoticed? I guess that's where i am at now.
It especially goes unnoticed when children aren’t in school yet bc they are sheltered.... and also when children are a little older and know how to cover up for their parents .... and even in low income areas where government and others who can make a difference don’t care to or aren’t exposed to it .
Appreciate your insights. Maybe will give me something to think on, a better solution.
I hope so .... I wish there was a clear cut answer ... a close friend of mine worked as a counselor in a high school in the south Bronx ... and the stories she would tell ... was sickening .... 6-7 kids under 15 living in a rat infested apt ... with one mattress up against the radiators with no sheets or blankets ..... freezing in the dead of winter ... or the step father that abused the kids but the kids were afraid of being taken away from the only family they knew ... it’s a scary world out there .
