Total dick move.
Unless their company is a secret arm of the military who makes games to secretly train civilians to fly jets...they should let him off with a fine.
Edit: For the record, as a programmer, I would absolutely do the same. It's not even necessarily for just "realism", because you have to do your research regardless. The Doom programmers bought a ton of books on military building design at the early stage of their game, and didn't even use much of what they played around with, because military buildings are boring. This probably isn't even the first time a programmer has gotten in trouble for this.
Hell, when the Mac Pro first came out, it was banned from sale in various countries due to it's extreme power. How many people illegally imported those because they felt like they needed them to develop software or make graphics or whatever?
Maybe he should have been more careful though. Or maybe he's just a victim of the slap fight between the US & Russia.
