BTC has forked before, but the current fork isn't fraudulent. Why is that any different than this, with the exception that this time, everyone got their investment back(actually paid out to the people).

The reason the old fork is still actually up and moving is because the community is using it, which was always an option with the fork, and everyone knew about it beforehand. If people weren't using the etc fork, it would die and be worthless, but at a 300% gain in 24 hours, it's too much money to stay out of.
