The Administrative Labor Tribunal orders crane operators to return to work
The Labor Administration Tribunal orders crane operators to return to Quebec shipyards as soon as Friday, 24 hours after the Quebec Construction Commission (CCQ) demanded the same thing in vain.
In an interim order, Justice Alain Turcotte orders the crane operators to "immediately offer their normal and usual work".
Affected unions, in particular the FTQ-Construction, have the "obligation" to remind their members of their responsibilities.
The CCQ reacted to the decision of the Administrative Labor Tribunal. "The CCQ hopes that the court's slogan will be heard quickly and that the illegal strike will cease without delay so that Quebec shipyards can return to their normal level of activity. The end of this conflict is for the benefit of all workers and employers in the industry, whose work is compromised. "
The Commission recalls that anyone who defies this order is liable to contempt of court. She faces fines of $ 10,000, or $ 100,000 for a corporation, and even a term of imprisonment.
The Conseil du patronat du Québec, for its part, "hailed" the decision of the Administrative Labor Tribunal on Twitter: "Return to work of the #groves a relief for the population and for the safety of the public; we welcome the decision of the Administrative Labor Court TAT #polQC no one is above the #construction laws ".
Crane workers shout in front of the CCQ offices
In the afternoon, Thursday, crane operators made a spectacular strike in front of the offices of the CCQ on Christophe-Colomb Avenue in Montreal.
The demonstration crane operators, illegal strike since Monday, wanted to demonstrate the dangers of the operation of an arrow truck on which is positioned a crane.
There were more than a hundred shortly after 1 pm at the rally, while major projects, including the new Champlain Bridge, were literally paralyzed by the illegal strike.
Crane operators denounce that the new rules put in place in the industry pose a risk to health and safety at work.
Company training
Since mid-May, construction companies have been able to train crane operators themselves instead of having to wait until they graduate, raising fears in the industry.
Thus, it is possible for a non-graduate who wishes to become a crane operator to follow a corporate training plan within a guarantee of employment of 150 hours for three consecutive months.
To obtain this right, a journeyman will have to pass an 80-hour training, as well as a qualifying examination, whose threshold of success is also set at 80%. He will have to prove every year that he has operated an arrow truck for at least 50 hours.
"False stake"
In a marathon of interviews given on this issue on Wednesday, CCQ CEO Diane Lemieux ruled that the safety issue raised by crane operators is not the real issue of this strike. She believes that the union authorities lied and took "incredible shortcuts".
"We get people out in the name of security, but that's not the issue. It's the monopoly. Seeing this overreaction, we think we have put our finger on something. We change the '' business ''.
Eventually, we will bring, in order, people in the trades of crane operators who are not in their circuit, "she said.
Diane Lemieux assured that the entire industry was consulted and accepted the changes.
The training offered to people who want to work in this industry without a diploma has been strengthened and enriched.
She recalled that all the actors had had the opportunity to express themselves on this question.
Thursday, Prime Minister Philippe Couillard reiterated that he wanted a return to work crane operators. He recalled that this story could be "expensive" for them.
